According to Her Lawyer, Amber Heard is Unable to Afford to Pay Johnny Depp Millions of Dollars

Actress Amber Heard could be in for more legal headaches because according to her lawyer, she is unable to afford to pay her ex-husband Johnny Depp the millions of dollars that she now owes him due to yesterday’s verdict.

While Depp was awarded $15 million, $10 million of it is compensatory damages and another $5 million in punitive damages.

The punitive damages amount is reduced to Virginia’s cap of $350,000 on such award and the jury also awarded Heard $2 million in her countersuit.

Attorney Sandra Spurgeon of Spurgeon Law Group in Lexington, Kentucky said that while Heard can appeal the verdict, she could be required to post a bond for the full $10.35 million judgment, plus interest, as the appeal proceeds.

Spurgeon told CBS MoneyWatch, “For an individual who doesn’t have the ability to pay the judgment and no ability to post the bond, then there is a real issue if the winning party intends to execute the judgment.”

Speaking to NBC’s “Today Show,” Heard’s lawyer Elaine Bredehoft was asked about whether Heard was able to pay the penalty.

Bredehoft responded, “Oh no, absolutely not.”

During the interview, Bredehoft added that Heard would appeal the verdict, and echoed Heard’s words that she used in a statement after the trial, saying that the verdict sends “a horrible message.”

CBS News noted that Heard previously received a $7 million settlement from Depp after their 2016 divorce, which she pledged to donate to charities including the American Civil Liberties Union.

During the trial, however, Heard said she hadn’t yet fulfilled the pledge because of Depp’s lawsuit and other testimony during the trial suggested that her career had stalled due to the legal battle with Depp.
