After a draft majority opinion written by Justice Samuel Alito was leaked to the press, many speculated that an investigation might be in order as to who facilitated the leak.
Chief Justice John Roberts confirmed in a statement today that such an investigation is set to take place as he put the chief operations and security officer of the court, the Marshal, in charge of it.
Roberts claimed in a press release, “Although the document described in yesterday’s reports is authentic, it does not represent a decision by the Court or the final position of any member on the issues in the case.”
In the statement, Roberts called the leak a “singular and egregious breach” of trust but defended the court’s workforce and integrity, insisting that it won’t undermine its operation.
“To the extent this betrayal of the confidences of the Court was intended to undermine the integrity of our operations, it will not succeed. The work of the Court will not be affected in any way,” Roberts began.
Roberts continued, “We at the Court are blessed to have a workforce – permanent employees and law clerks alike – intensely loyal to the institution and dedicated to the rule of law. Court employees have an exemplary and important tradition of respecting the confidentiality of the judicial process and upholding the trust of the Court. This was a singular and egregious breach of that trust that is an affront to the Court and the community of public servants who work here.”
“I have directed the Marshal of the Court to launch an investigation into the source of the leak,” Roberts concluded.
It has been speculated that Amit Jain, Justice Sonya Sotomayor’s secretary, could be the source of the leak, although nothing has been confirmed yet.

The “Marshall of the Court” MUST be FIRED for incompetence. Roberts needs to go. It would be real simple to fine the culprit. This IS a national security issue and you find the reporter that leaked the story and ask where the info came from? If the reporter refuses to give a name, then prosecution and jail time for the reporter for violating national security.
