Harvard Law professor emeritus Alan Dershowitz took U.S. House Rep Jamie Raskin (D-MD) to task over the House Jan. 6 Committee’s “unconstitutional” criminal referrals.
The panel recommended that the DOJ prosecute Trump on charges of inciting an insurrection, conspiracy to defraud the United States, conspiracy to make a false statement, and obstruction of an official proceeding.
Dershowitz put it bluntly on Sean Hannity’s Fox News show, “Jamie Raskin was my student. I defended his father against Georgia, relating to the Vietnam War. He’s a professor of constitutional law. He knows Congress doesn’t have this power to refer.”
“The McCarthy Committee did that, too, in the 1950s. They would specify individuals and call on the prosecutors to go after them. And, we civil libertarians strongly objected to that,” Dershowitz insisted.
Dershowitz referenced three specific provisions in the Constitution that he believes it violates explaining, “It’s never been done before, because it’s unconstitutional.”
Raskin declared in a tweet yesterday, “The @January6thCmte refers Trump and [John] Eastman for conspiracy to defraud the United States.”
“The point of their scheme was to replace a lawful presidential election with a fraudulent one defined by counterfeit electors and violent force. A grave offense against democracy,” Raskin claimed.
Eastman was referred by the committee for possible charges of obstruction of an official proceeding and conspiracy to defraud the United States.
