Texas AG Ken Paxton Suing Joe Biden to Block ‘Millions of Dollars from Going to Illegal Immigrants’

Texas Attorney General Ken Paxton (R) has filed a lawsuit to block the Biden Administration from enacting funds going to illegal immigrants in Texas.

Paxton’s suit claims the package was passed illegally, and has called it unconstitutional.

He shared the news of his suit on Twitter:

“BREAKING: We’re suing the Biden Admin to block the unconstitutional $1.7 trillion omnibus package. Today, I filed for an injunction to stop its enactment and prevent millions of dollars from going to illegal immigrants in Texas.”

The tweet also contains an image that explains how the $1.7 trillion dollar was passed in the House under former Speaker of the House Nancy Pelosi (D-CA) was unconstitutional.

His office also issued a press brief on the lawsuit:

Attorney General Paxton is suing President Biden and members of his Administration over the unlawful signing and implementation of the Consolidated Appropriations Act of 2023, which was the latest omnibus spending bill. 

The U.S. Constitution requires that a quorum of members of the U.S. House of Representatives be present for the lower chamber of Congress to conduct business. When the House passed the Consolidated Appropriations Act of 2023 in December 2022, fewer than half of its members were present and more than half voted by proxy. 

The U.S. Constitution empowers a quorum-less House only to “adjourn from day to day” or “compel the attendance of absent members.” Because “attendance” means physical presence, the U.S. Constitution does not allow voting by proxy to constitute a quorum. And because the omnibus spending bill wasn’t passed when a quorum of the House was present, it was never lawfully enacted, is unconstitutional, and the federal government should be enjoined from implementing it.  

As Pelosi has shown recently in our view, she doesn’t have an understanding of America’s laws or the judicial system. She tweeted that former President Donald Trump will have to prove his innocence, which is not how the judicial system in America is supposed to work. Americans who face criminal charges are to be viewed as innocent until proven guilty.

We wish Paxton well in his attempt to block the $1.7 trillion spending bill.
