On Friday’s Megyn Kelly Show podcast, Alan Dershowitz told Kelly he believes Special Counsel Jack Smith could face an indictment for omitting a key portion of former President Donald Trump’s speech on January 6th, in Washington D.C.
In the indictment where Smith recounts Trump’s speech at the “Stop the Steal” rally, Smith omits the part of the speech Trump where emphasized being peaceful. Trump told the rally audience “I know that everyone here will soon be marching over to the Capitol building to peacefully and patriotically make your voices heard.”
Smith only focused on the phrase used by Trump, “fight like hell” in the indictment.
Dershowitz stated, “Under the indictment itself, Jack Smith could be himself indicted. He told a direct lie in this indictment. He purported to describe the speech that President Trump made on January 6th. And he left out the key words, when President Trump said, ‘I want you to demonstrate peacefully and patriotically. You know, a lie by omission, under the law, can be as serious as a lie by commission.”
This according to Breitbart is the same “error” that was made by the House impeachment managers. During the impeachment trial, Trump’s lawyers played footage of Democrat’s use of similar rhetoric to show it is commonly used in political speeches.
Former Speaker of the House Newt Gingrich told Fox News he believes Attorney General Merrick Garland could face obstruction of justice charges for the vast difference in the DOJ’s handling of Biden and Trump. Gingrich claimed, “The timeline of events is weird”. When some revelation about the Biden family is made public, Trump is charged the following day. It seems to him and many others that it is politically motivated.
It doesn’t appear likely that either of these things will happen, that is unless Republicans manage to take back the White House and or possibly the Senate. We will see what 2024 holds for them.
