In what appears to be a temporary win for U.S. Senator Lindsey Graham (R-SC), Supreme Court Justice Clarence Thomas has temporarily blocked a subpoena from an Atlanta grand jury requesting testimony from the Senator.
Thomas ordered an administrative stay order, pending further order of the undersigned or of the Court.
The Fulton County special purpose grand jury had subpoenaed the senator to testify in the investigation of possible “criminal” efforts to overturn the election in Fulton County Georgia.
With the request coming from Georgia, Justice Thomas is responsible to handle emergency requests from the state. This was filed on Friday by Graham, after the appeals court ruled that he must testify.
Graham argued that his post-election efforts in Georgia count as legislative activities and so he says he is protected from these types of investigations.
Now, the Georgia investigators have until Thursday to respond to the order, at which time it is expected that Thomas will likely give his judgment with their provided information unless they fail to comply.
