After having their first defamation suit against actor Alec Baldwin dismissed due to not being filed in the correct state, the family of a fallen marine who was killed in last year’s Kabul, Afghanistan terrorist attack has filed a new suit.
The first suit was filed in Wyoming, where Rylee McCollum’s sisters Roice and Cheyenne live, while the new one, seeking $25 million, is in New York, where Baldwin resides.
Rylee’s widow, Jiennah, who lives in California, is also part of the suit, as Baldwin sent Roice a check for $5,000 after he was killed to be given to her and her newborn baby.
Ahead of the anniversary of Jan. 6, Roice posted a picture on Instagram of herself at the protest that had occurred last year outside the Washington Monument.
Incensed, Baldwin commented on her post and asked if she was the same woman that he had sent the money to previously.
Baldwin also reportedly sent Roice a direct message where he said, “When I sent the $ for your late brother, out of real respect for his service to this country, I didn’t know you were a January 6th rioter.”
Roice responded by telling Baldwin, “Protesting is perfectly legal in the country and I’ve already had my sit down with the FBI. Thanks, have a nice day!”
“I don’t think so, Your activities resulted in the unlawful destruction of government property, the death of a law enforcement officer, an assault on the certification of the presidential election,” Baldwin replied.
Baldwin then told Roice, “I reposted your photo. Good luck.”
The suit then contends that within 20 minutes of Baldwin reposting the photo on his Instagram, Roice received “hostile, aggressive, hateful messages” from his fans.
Despite not being in D.C. that day, Baldwin also misidentified Jiennah as an insurrectionist in an Instagram comment, the suit also claims.
