Supreme Court Justice Sonia Sotomayor made Fox News’ Brit Hume wince today when she falsely suggested that upwards of 100,000 children in the United States are hospitalized from COVID-19, many of them on ventilators.
The claim came during oral arguments on the Biden administration’s mandate on private businesses for employees to be either vaccinated or frequently tested.
Hume responded to the news of Sotomayor’s gross miscalculation by stating, “Good lord.”
Sotomayor said during the arguments, “We have hospitals that are almost at full capacity with people severely ill on ventilators. We have over 100,000 children, which we’ve never had before, in serious condition, many on ventilators.”
Good lord. https://t.co/DOcWCYSjJY

While there are more children hospitalized now than at any point during the pandemic, according to the Centers for Disease Control and Prevention, the number is nowhere near 100,000.
The Washington Post reported that the seven-day average of pediatric hospitalizations was around 3,700 this week, according to the CDC.
Younger people are at far less risk than old ones of severe outcomes from the coronavirus, similar to prior strains of the virus.
Greg Price listed out a number of issues that have been highlighted with Sotomayor’s arguments in a tweet.
“Justice Sotomayor during this oral arguments: Claimed covid deaths are at an all time high, claimed that Omicron has been deadlier than Delta, claimed 100K children are hospitalized with covid, said OSHA’s regulatory authority is a federal ‘police power.'”
“Justice Sotomayor also claimed that hospitals are nearing capacity. She also asked ‘Why is a human spewing a virus not like a machine spewing sparks?’ Incredible performance all around.”
