A former business partner of Hunter Biden and former fellow Burisma Board member, Devon Archer, was finally sentenced today to a year and a day in prison for his role in a $60 million fraud scheme.
Prior to his 2016 arrest, Archer served with Hunter Biden on the board of Burisma Holdings, a Ukraine-based energy company.
Additionally, Archer will have 1 year of parole and be subject to a $15 million forfeiture for defrauding a Native American tribe.
Archer and two others were convicted in 2018 of conspiracy to commit securities fraud and securities fraud, following a five and half week jury trial.
The same year, Archer had his conviction overturned by the judge in that trial, Obama-appointed U.S. District Judge Ronnie Abrams.
Abrams, who is married to Mueller special counsel prosecutor Greg Andres, said at the time that she was “left with an unwavering concern that Archer is innocent of the crimes charged.”
In 2020, a three-judge panel of the U.S. Court of Appeals for the Second Circuit reversed the decision by Abrams after federal prosecutors appealed.
Archer then appealed to the Supreme Court who refused to hear the case ultimately sealing his fate.
Abrams was ultimately the judge to hand down the sentence and she gave him less than the 30 months requested by prosecutors, parity with co-defendant Bevan Cooney, and cited COVID as a reason for the lesser sentence
The New York Post’s Miranda Devine noted that “Only a presidential pardon will save him.”
Judge Ronnie Abrams said the crime was too serious for the non custodial sentence Archer’s lawyer requested. But the sentence was less than the 30 mths requested by prosecutors, parity with co-defendant Bevan Cooney. Judge Abrams cited COVID as a reason for the lesser sentence
