According to a memo obtained by Axios, Democratic Senate Majority Leader Chuch Schumer (NY) has found a loophole to bring voter legislation to the Senate floor.
In the latest effort to bypass Senate rules, it appears Democrats are going to use a similar tactic they used last month to bring the debt limit to the floor and eventually got it passed.
This loophole will allow Democrats to bypass the first filibuster allowing the bill to the floor for debate.
It seems the plan is to strip the language in an amendment the House is taking up related to NASA leasing property to private groups a, “shell bill”. This language will be replaced by the language from Freedom to Vote Act, and the John Lewis Voting Rights Advancement.
Upon passing the House and being sent to the Senate as a “message” Schumer will file a motion to concur with the House amendment. This will allow the Senate to take up the bill and debate it on the floor.
This doesn’t mean that the bill will be passed. The Senate would still need to get rid of the filibuster in order to get legislation passed. Currently, Democrat Senators Joe Manchin (WV) and Kyrsten Sinema (AZ) are opposed to the ‘nuclear’ option on the filibuster.
It appears the Democrats still have no way forward with the voter reform legislation, but this shows they are looking at every possibility to get it through.
