U.S. House Rep Eric Swalwell (D-CA) is the latest Democratic elected official to file a lawsuit against former President Trump, alleging in federal court that he and others are “responsible for the injury and destruction” of the Jan. 6 siege on the U.S. Capitol.
In a statement, Swalwell accused Trump of filing his own “frivolous lawsuits” after the November election and for “waging all out war on a peaceful transition of power.”
Today, I filed a civil claim against Donald Trump, Donald Trump Jr., Rudolph Giuliani, and Rep. Mo Brooks for inciting an attack against the Capitol that terrorized lawmakers and prevented us from certifying the votes of the American people.

Last month, we reported that U.S. House Rep Bennie Thompson (D-MS) had joined with the NAACP to file a lawsuit against Trump and Rudy Giuliani, this lawsuit lists both men as well as Trump’s son, Donald Trump Jr., and Swalwell’s colleague, U.S. House Rep Mo Brooks (R-AL).
Swalwell was one of the House Impeachment managers in Trump’s Senate impeachment trial last month where he was acquitted.
Last December, Swalwell found himself in a scandal of his own that culminated with the unprecedented step of the FBI briefing House leaders Nancy Pelosi (D-CA) and Kevin McCarthy (R-CA) about his interactions with a Chinese spy.
McCarthy said he believed that Swalwell should be removed from the House Intelligence Committee, but Pelosi took no action.
Former Georgia State House Rep Vernon Jones previously summed up the feelings of many Republicans when it comes to lawsuits over “incitement” and asked, “Why hasn’t someone in congress filed a civil suit against @blm or ANTIFA for their riots, burnings and killings?
