Biden Tells ’60 Minutes’ that Court System ‘Is Getting Out of Whack’ and He Will Form a Commission if Elected

Democratic Presidential nominee Joe Biden, in a clip released of an interview with CBS’ Norah O’Donnell and 60 Minutes, claimed that the court system is “getting out of whack.”

The clip released begins with Biden saying, “If elected what I’ll do is I’ll put together a national bipartisan commission of Constitutional scholars, Democrats, Republicans, liberal conservatives and I will ask them to over 180 days come back to me with recommendations as to how to reform the court system.”

“It’s getting out of whack, the way it is being handled. It’s not about court packing there are a number of other things that our Constitutional scholars have debated and I’d look to see what recommendations that commission would make,” he continued.

O’Donnell then interjected, “So you’re telling us, you’re going to study this issue whether to pack the court?”

Biden then attempts to deny and reframe the question, “No, well there’s a number of alternatives that go well beyond packing.”

“This is a live ball,” O’Donnell responds and Biden agrees, saying, “Oh it is a live ball, no it is a live ball, we’re going to have to do that.”

“You’re going to find there are a lot of conservative Constitutional scholars that are saying it as well. The last thing we need to do is turn the Supreme Court just into a political football. Whoever has the most votes, gets whatever they want,” he explained.

He concluded, “Presidents come and go, Supreme Court Justices stay for generations.”
