Friday Federal Judge, Matthew Kacsmaryk, ruled that President Biden must reinstate Migrant Protection Protocols (MPP) also known as the “Remain in Mexico” policy that was implemented under former President Donald Trump.
Missouri and Texas had filed a lawsuit, in April, against the Biden Administration over immigration policy. Attorney General Eric Schmitt tweeted out the ruling.

Texas Attorney General account tweeted, “ANOTHER VICTORY! We just won our second immigration lawsuit against the Biden Admin! The Biden administration formally ended MPP on June first of this year, Biden had stopped any new enrollment on his first day in office on January 20th.
June and July of this year have seen the highest numbers of migrant border crossings in two decades with 212,672 migrants taken into custody in July. June numbers were already at a 20 year high with 188,829. The numbers keep increasing and have escalated since Biden took office at the end of January.

The lawsuit brought by the two states claimed, “MPP played a critical role in addressing” the immigration border crisis and it also “discouraged aliens from attempting illegal entry or making meritless asylum claims in the hope of staying inside the United States”.
The Judge’s ruling states that the Biden administration must ” enforce and implement MPP in good faith” until it is “lawfully rescinded”.
The ruling also found that DHS Secretary Mayorkas failed to consider the benefits of MPP and that Mayorkas failed to address false asylum claims that would discourage some from traveling to the border. DHS had previously found that 9 out of 10 asylum claims from Northern Triangle countries are ultimately found not to have merit.
“By ignoring its own previous assessment on the importance of deterring meritless asylum applications without ‘a reasoned analysis for the change,’ defendants acted arbitrarily and capriciously.”
This is a major win in the battle at the border the Biden administration and DHS have been successfully called out on their negligence regarding our southern border. There may be more hurdles ahead to see how quickly the program will be reinstated.
As Texas and Missouri take a victory lap the numbers at the border seem to still be escalating. This ruling will hopefully guide the crisis back in the right direction and many hope that the numbers are the border will begin to drop.
