Despite ‘Credible’ Allegations of Improper Conduct, Westchester DA ‘Unable’ to Charge Andrew Cuomo ‘Due to the Statutory Requirements of the Criminal Laws of New York’

Westchester DA Miriam Rocah announced today that despite “credible” allegations of improper conduct against him, she was unable to charge former NY Gov. Andrew Cuomo.

Cuomo was accused by two separate women of inappropriate conduct, specifically kissing their cheeks while he was governor.

The New York City suburb was where a state trooper and another woman said they were subjected to unwanted physical contact by the former governor, which led to Rocah’s office being tasked to review the allegations.

Rocah is a former Assistant U.S. Attorney who was promoted during the Obama administration and was elected to her current position in November 2020.

In a statement, Rocah said that “Our investigation found credible evidence to conclude that the alleged conduct in both instances described above did occur.”

“However, in both instances, my Office has determined that, although the allegations and witnesses were credible, and the conduct concerning, we cannot pursue criminal charges due to the statutory requirements of the criminal laws of New York,” Rocah claimed in the statement.

In a nod to the #MeToo movement, Rocah explained, “We continue to recognize the bravery of the women and witnesses who have cooperated with law enforcement and we remain committed to supporting them and all survivors.”

“As in all cases of alleged misconduct, my Office will investigate such claims irrespective of the position or status of the accusers or the accused,” Rocah insisted.
