Friday, Judge Lisa B. Lench ruled that actor and director Mel Gibson will be able to testify for the prosecution against Harvey Weinstein. Gibson is set to testify in support of his masseur and friend who is known as Jane Doe #3 at the trial.
The prosecutors said, in May of 2010 after giving Weinstein a massage the woman was followed by a naked Weinstein into the bathroom, where he masturbated. Weinstein has pleaded not guilty.
Prosecutors also stated, that while Gibson and Jane Doe #3 were talking Weinstein’s name came up by chance and the woman had a traumatic response. Gibson understood that she had been sexually assaulted. The prosecution will use another witness, Allison Weiner, who has spoken to both to establish timing.
Mark Werksman, Weinstein’s attorney asked for permission to cross-examine Gibson, about antisemitic remarks. The remarks were widely publicized during an arrest in 2006. He also requested to cross-examine him about racist statements that were recorded which he made to a girlfriend in 2010.
The judge denied the request stating Gibson’s racism was not relevant to the trial. She will however allow the question of whether or not Gibson has a personal bias and animus toward Weinstein.
Werksman claimed Gibson had bias as Weinstein is Jewish and because he published a book that criticized the depiction of Jews in “The Passion of the Christ”.
Other witnesses were also approved to testify on Friday as well, including “Melrose Place” actor Daphne Zuniga.
The trial is estimated to last eight weeks and jury selection will begin on Monday with opening statements expected to begin on October 24th.
Weinstein is currently serving a 23-year sentence for a 2020 conviction for rape and sexual assault in New York. Weinstein has been granted an appeal in this case.
