Missouri’s new Attorney General Andrew Bailey has issued a warning for St. Louis Circut Attorney Kim Gardner, either she resigns by noon or his office will remove her.
Wednesday after much public backlash over Gardner’s office’s mishandling of cases Bailey shared on Twitter:
“We are giving Kim Gardner until noon tomorrow to resign. If she refuses, she will face immediate removal proceedings in the form of a writ of quo warranto brought by our office.”
“As AG, I want to protect the people of St. Louis, and that includes protecting victims of crime and finding justice for them. Instead of protecting victims, Circuit Attorney Gardner is creating them. My office will do everything in its power to restore order, and eliminate the chaos in St. Louis caused by Kim Gardner’s neglect of her office.”
This action was brought forth after a young girl lost one of her legs after Daniel Riley ran into the vehicle she was in as he failed to yield and was speeding. Riley was out on bond after Gardner’s office dropped charges and later re-filed.

Gardner is the same attorney that charged the McCloskeys with one count of unlawful use of a weapon after a mass amount of people broke a gate and came across their lawn during a protest. The McCloskeys were frightened and armed themselves for protection. No one was hurt during the incident but it made national news and the only ones charged were the McCloskeys. Gardner was later removed from the case.
Gardner issued a statement on the tragic incident and the backlash she has received:
“A young girl’s life was tragically changed because of the inexcusable behavior of a young man. Our hearts go out to the victim and her family for this unspeakable tragedy that will undoubtedly have a lasting impact not only on her, but her family and loved ones. It’s unfortunate that there are those who choose to twist the facts to take advantage of this situation for their own selfish motives. This is not the time for finger pointing, it’s time to support this family, and ensure that justice is served.”
Gardner has refused to resign and Bailey’s office is now in the process of filing a petition quo warrantor to remove her.
