Mathew Martin, a New Mexico man who entered the Capital on January 6th, 2021, has been acquitted on misdemeanor charges.
“A judge said it was reasonable for Matthew Martin to believe that outnumbered police officers allowed him and others to enter the Capitol through the Rotunda doors on Jan. 6, 2021.”

U.S. District Judge Trevor McFadden, who was nominated by former President Donald Trump on June 7, 2017, and was confirmed by the Senate on October 30, 2017, by a vote of 84-10 made the ruling Wednesday. Martin entered the Capital through the Rotunda doors and Judge McFadden argued it was reasonable for Matin to believe that the Capital Police were letting the protestors in.
McFadden called his conduct, “as minimal and non-serious” compared to other protesters who have been deemed more violent than those simply walking through the halls of Congress. Martin also claimed that an officer waved him which echoes the arguments of many other conservatives.
Judge McFadden called his testimony “largely credible.” while Department of Justice prosecutor Romano called parts of his testimony “nonsense”. Either way, Martin was able to get out of serving time even after the Department of Justice went after him.
While those on the right may see this as justice, most Democrats are angry that a January 6th protestor was allowed to walk freely. There is certainly a wide range of views on the subject and we are just presenting them to you.
“I spoke to several people that day who said police invited them in, plus there is video of police holding doors open and waving in throngs of people who just strolled through.”

“Ok this is humorous…Matthew Martin is before Judge Trevor McFadden today for a bench trial on the usual 4 low-level misdemeanors. I have serious issues with McFadden’s handling of pre-trial detention but he’s calling out DOJ on these 1752 charges:
DOJ is so nervous about the case they brought in chief of criminal division to defend the government’s case:”
