Judge Places Gag Order on Law Enforcement, Investigators and Lawyers as Bryan Kohberger is on His Way to Idaho

On Tuesday, Bryan Kohberger who stands accused of murdering four college students from the University of Idaho in Moscow Idaho waived extradition. According to TMZ he is on his way back to Idaho now and will be traveling by plane.

Pennsylvania State Police shared that he would be flying back, however, they did not mention if he would be flying commercially. Kohberger was moved from the Monroe county Correctional facility around 6 AM EST this morning.

Kohberger is set to face a judge in Idaho within 24 to 48 hours of arriving in the state.

Brian Entin of NewsNation shared what will likely happen upon his arrival in Idaho.

“Moscow Police will not give specifics about Bryan Kohberger’s transportation to Idaho because of security concerns. Once there – he will be served with the arrest warrant for the murders. Then the probable cause affidavit will be unsealed.”

With the unsealing of the probable cause affidavit, Kohberger as well as the public will learn at least to some extent what the police have on him.

Entin continued, “Kohberger will have an initial court appearance where a magistrate judge will explain to him his rights and the charges against him. Kohberger will not be asked his plea during this hearing. This is when a preliminary hearing is scheduled.”

Currently, at least it does appear media will be allowed to film inside the courtroom unless this is changed.

“Based on the court orders– it does appear cameras will be allowed in the Idaho courtroom. Once back in Idaho — we are told Kohberger will be held in the Latah County Jail.”

Tuesday night a judge issued a gag order prohibiting communication about the case. This order encompasses law enforcement, investigators, attorneys, agents of the prosecuting attorney as well as the defense attorney.

“Moscow, Idaho Police say they will no longer be communicating with the public or the media about the Bryan Kohberger case. Judge is prohibiting any communication by investigators, law enforcement, attorneys, and agents of the prosecuting attorney or defense attorney.”

This doesn’t appear to affect the release of the probable cause affidavit. It appears that what questions may arise from the release of the affidavit will likely go unanswered at this time.

“I don’t believe this will impact the probable cause affidavit becoming public. That will be a public document. This order is more about people connected to the case talking about it outside of court.”

With the report from TMZ, it appears that Kohberger could be in Idaho later today. Kohberger will receive a public defender as he cannot afford a private lawyer it is being reported that public defender Anne Taylor will be his defense attorney.
