Far-left Democrats have begun to call for the soon retiring Justice Breyer’s seat to be filled by a black woman following the news leak earlier today.
As we previously reported, “Supreme Court Justice Stephen Breyer has announced that he plans to retire which will clear the way for Joe Biden to nominate a replacement while Democrats still hold the Senate. Breyer was appointed to his position by former President Bill Clinton and has served as a consistently liberal voice on the bench.
During a September appearance on Stephen Colbert’s late-night show, he was asked about the possibility of retiring. Breyer responded at the time, ‘Am I going to retire? Eventually. I don’t want to die.’ “

The Biden Administration said they would do so as White House Press Secretary Jen Psaki confirmed on Wednesday according to Johnathan Turley.
“Jen Psaki just reaffirmed that the President will only consider a black woman for the next nomination — a threshold gender and race condition that the Court itself has found unconstitutional for schools and unlawful for private businesses. The Biden Administration has been found previously to have engaged in racial discrimination in federal programs. However, fortunately for the President, Supreme Court nominations are not subject to the same constitutional scrutiny.”

According to Fox News host Shannon Bream, Justice Breyer wasn’t expecting to announce his retirement today and was therefore upset about the news being released early, “Multiple sources tell me Justice Breyer was not planning to announce his retirement today. They describe him as “upset” with how this has played out. We still await any official notice from his office and/or the #SCOTUS public information office.”

CNN displayed some potential contenders for the nomination, as it appears Joe Biden won’t nominate anyone to the Supreme Court unless they are black and are a woman.

Some have floated Kamala Harris being nominated to the Supreme Court, though the Democrats would suffer immensely from it if she was confirmed as described by Sean Davis on Twitter:
“Democrats should totally do that. Harris wouldn’t be allowed to vote on her own nomination, and if somehow she were confirmed, the vice presidency would be vacant, meaning Democrats would no longer have a Senate majority. And it takes a Senate majority to confirm a new VP.”
