Texas Abortion Law Challenge Given Huge Blow, Sent to Entirely Republican Texas Supreme Court

Democrats have now been trying to stop the new Texas abortion law which bans abortions once a heartbeat is detected and has been in effect since September of last year.

Since then, liberals have been trying to overturn this law in the courts but have mainly been unsuccessful as the Supreme Court upheld the law in December as we previously reported, “Yesterday, we reported that the Supreme Court had declined to stop Texas from blocking almost all abortions after six weeks. Last night, they voted 5-4 to cement that decision.

The Texas Republican bill will stand, and almost bans all abortions. There is much speculation that Roe V. Wade could be in Jeopardy. Liberals are melting down on this news. Justice Sotomayor dissented and so-called conservative Justice Roberts joined with the liberals.

However, the challenge to the Texas abortion law was just hit with another huge setback as the Fifth Circuit Court of Appeals ruled 2-1 to send the case to the Texas Supreme Court. This almost certainly dooms their challenge to the law as the Texas Supreme Court is made up of nine Republican justices.

This means they would need five Republican justices to vote to overturn the law, some could argue there is a better chance that the sun doesn’t rise tomorrow. We will have to wait and see how and when the state’s Supreme Court rules but the abortion law doesn’t look like it is going anywhere.
