Trump Appointed Federal Judge Strikes Down CDC Mask Mandate for Travelers

Today, Trump-appointed Judge Kathryn Kimball Mizelle struck down the CDC mask mandate for airplanes and other public transportation.

Judge Mizelle declared the mandate unlawful because it exceeded the US Centers for Disease Control and Prevention’s statutory authority and because its implementation violated administrative law in the 59-page decision.

The CDC had just extended the mask mandate last week, April 13th, through May 3rd. The mask mandate has been in place since 2020.

As of now, there has been no response from the Biden Administration, it is unclear if they will attempt to use a different method to keep in place the mask mandate. It also has not been clarified exactly when this will end the now unlawful mandate issued by the CDC.

Congressman Andy Biggs (R-AZ) shared the news on Twitter, “Biden’s unlawful mask mandate for travel has been struck down by a federal judge. The CDC exceeded its statutory authority in issuing the mask mandate.”
