Mo Brooks Claims Eric Swalwell’s Team Trespassed Into His Home and Accosted His Wife

Candidate for U.S. Senate Mo Brooks, alleges that Democratic Representative Eric Swalwell’s team (CA) illegally broke into Brooks’ Alabama home. Brooks claimed in a tweet that, “HORRIBLE Swalwell’s team committed a CRIME by unlawfully sneaking INTO MY HOUSE & accosting my wife! Alabama Code 13A-7-2: 1st degree criminal trespass. Year in jail. $6000 fine. More to come!”

Swalwell’s legal team has been attempting to serve Brooks with a lawsuit to hold him ‘accountable’ for the January 6th “insurrection”. Swalwell is suing former President Donald Trump, Donald Trump Jr., Rudy Giuliani, and Brooks under claims that they broke Washington, D.C. laws, committed terroristic acts, incited a riot, aided and abetted violent rioters, and inflicted emotional distress on members of Congress. Swalwell’s lawsuit alleges this against Brooks: “Brooks-acting in his personal capacity- conspired with the other Defendants to undermine the election results by alleging, without evidence, that the election had been rigged and by pressuring elected officials, courts, and ultimately Congress to reject the results.”

More excerpts from the lawsuit accuse Trump as also being guilty of encouraging an insurrection saying, “Trump implored the crowd to ‘fight like hell’ and ‘walk down Pennsylvania Avenue . . . to the Capitol.’ According to an analysis of cell phone location data, approximately 40% of the rally attendees did just that. As a direct and foreseeable consequence of the Defendants’ false and incendiary allegations of fraud and theft, and in direct response to the Defendants’ express calls for violence at the rally, a violent mob attacked the U.S. Capitol. Many participants in the attack have since revealed that they were acting on what they believed to be former President Trump’s orders in service of their country.” Swalwell has been insistent on Twitter that he will make the GOP pay for what he believes is an insurrection.

The Swalwell team claimed that they had been trying to serve Rep. Brooks with the lawsuit but Brooks was nearly impossible to get in contact with. Starting in May, Swalwell allegedly called the congressmen’s office multiple times and even sent a formal letter to Brooks notifying him he was being sued. Due to this, Federal Judge Amit Mehta informed Swalwell legal team that they had only 60 more days to serve the lawsuit to Brooks. The judge also denied requests that a U.S. marshal deliver the lawsuit “due to separation of powers concerns”.

Because of this, the Swalwell team decided to hire a private investigator to expedite the process. The P.I. met with two separate staffers under Brooks twice and, “each time was promised a return call that never came.” Brooks’s attorney expressed his frustration on CNN this week saying, “The problem here is that Mo Brooks’ door is under lock and key … There was just no access to the primary place that he was for much of the day. It just takes persistence and luck sometimes. We’re not claiming Brooks is hiding in a bunker somewhere. But it takes a lot of effort.”

Rep. Brooks hinted that he intends to sue Swalwell’s team for 1st-degree criminal trespassing. A spokesperson under Brooks claims that a complaint has been filed with police authorities. Brooks’ Communication Director, Clay Mills told the Washington Post, “Swalwell’s process server entered the Brooks’ home without Martha Brooks’ knowledge and without her consent. Then he refused to leave when Mrs. Brooks demanded it. There is video proof.”

Swalwell’s attorney, Philip Andonian has denied all these allegations. Andoian released a statement on this: “No one entered or even attempted to enter the Brooks house. That allegation is completely untrue. A process server lawfully served the papers on Mo Brooks’ wife, as the federal rules allow. This was after her initial efforts to avoid service. Mo Brooks has no one but himself to blame for the fact that it came to this. We asked him to waive service, we offered to meet him at a place of his choosing.” Andonian labeled Brooks as acting juvenile and trolling the lawsuit on Twitter: “Instead of working things out like a civilized person, he engaged in a juvenile game of Twitter trolling over the past few days and continued to evade service. He demanded that we serve him. We did just that.”

In a tweet last Friday, Brooks mocked Swalwell and his lawsuit, saying “@ericswalwell is apparently trying to “find me” to discuss my Save America speech. Have you seen me out?! Good ol’ Patriots have! Guess the libs aren’t looking so hard.”

This incident infuriated many Conservative voices across Twitter. Rep. Marjorie Taylor Greene attacked Swalwell, implied that he partook in this illegal activity due to having a Chinese spy for a girlfriend. Greene also warned Swalwell that Alabama judges will not be, “as forgiving as Pelosi”, referencing the criminal trespassing lawsuit that might be filed against Swalwell.

Rep. Swalwell has received lots of heat for his alleged relationship with Fang Fang, who many label as a Chinese spy. Swalwell was well associated with Fang, who helped fundraise for Swalwell’s 2014 campaign, bringing in large donors for Swalwell. This Fang character, according to U.S. intelligence officers had engaged in sexual or romantic relationships with at least two mayors in the Midwest over three years. Two of these relationships have been caught on FBI electronic surveillance. Counterintelligence officials believe that Fang worked under China’s Ministry of State Security, which is Chian’s main civilian spy agency.

Once an investigation began into Fang in 2015, senior U.S. intelligence officers warned a multitude of local and national politicians previously associated with Fang off her alleged background. Fang has not been seen in the U.S. since this information was released.

In February, 14 House Republicans asked FBI Director Christopher Wray for a briefing discussing, “counterintelligence threats to Members of Congress.” Fox News host Tucker Carlson accused Swalwell of being sexually involved with Fang. Carlson asked Swalwell’s office on this matter and the office gave no definitive answer. Swalwell’s office told Axios, who first reported on his relationship with Fang, “Rep. Swalwell, long ago, provided information about this person — whom he met more than eight years ago, and whom he hasn’t seen in nearly six years — to the FBI. To protect information that might be classified, he will not participate in your story.”
